Terms of Service

These terms govern your use of the PupCal app for iOS and Android and the website at https://pupcal.app (together, "PupCal"), which are operated by PupCal ("we", "us"). By downloading, installing or using PupCal you agree to these terms. If you do not agree, please do not use PupCal.

1. Acceptance and eligibility

You must be able to enter into a binding agreement under the laws of your country, or use PupCal with the consent of a parent or guardian. The terms of the App Store or Google Play from which you downloaded PupCal also apply to your use of the app.

2. Your licence to use PupCal

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use PupCal on devices you own or control, for your own non-commercial use. This licence does not give you any ownership of PupCal or its content.

3. In-app purchases

PupCal is free to download, and every calendar feature and widget is free. The Yorkie companion is included. The five other puppy companions are optional one-time purchases, individually or as a pack, that unlock that companion's illustrations for as long as the app is available on your store account.

Purchases are made through Apple or Google under their terms. Prices are shown in your local currency in the store before you confirm, and may differ between countries and over time. Payment, receipts and refunds are handled by the store according to its policies; we cannot issue refunds directly.

Purchases are tied to the store account used to buy them. You can restore them in Settings on any device signed in to the same Apple or Google account. Purchases cannot be transferred between the App Store and Google Play, and they do not include your countdown data, which lives only on your device.

4. Your content

The days you create in PupCal, including their names and dates, belong to you. They are stored on your device, and we never receive a copy. You are responsible for keeping backups: PupCal can export a backup file from Settings, and you decide where it is saved. Because we hold no copy, we cannot recover days that are lost when a device is reset, replaced or lost.

5. Acceptable use

You agree not to:

  • copy, modify, distribute, sell or rent any part of PupCal or its illustrations;
  • reverse engineer, decompile or attempt to extract the source code or assets of PupCal, except where the law expressly allows it;
  • circumvent or attempt to circumvent purchase verification;
  • use PupCal in any way that breaks the law or infringes the rights of others.

6. Intellectual property

PupCal, its name, design, text and all puppy and scenario illustrations are owned by PupCal or its licensors and are protected by copyright and other laws. Apart from the licence above, no rights are granted to you. In particular, the illustrations may not be extracted, reproduced or used outside PupCal.

7. Updates, changes and availability

We may update PupCal, add or remove features, or stop offering it. Widgets, reminders and purchases depend on your device, operating system and store, and we cannot promise that they will always be available or work in the same way on every device. Reminders are scheduled locally by your phone and may be delayed or suppressed by its settings.

8. Disclaimer of warranties

PupCal is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. Countdowns depend on the date, time and time zone of your device. PupCal is a companion, not a substitute for an official calendar or reminder system for anything critical.

9. Limitation of liability

To the fullest extent permitted by law, PupCal is not liable for any indirect, incidental, special or consequential damages, or for loss of data or profits, arising from your use of or inability to use PupCal. Our total liability for any claim relating to PupCal is limited to the amount you paid us for PupCal in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited under the law of your country of residence.

10. Changes to these terms

We may revise these terms from time to time. The date at the top shows when they were last changed. If a change is material, we will point it out in the app or on the website. Continuing to use PupCal after a change means you accept the revised terms.

11. Governing law

These terms are governed by the laws of Taiwan (Republic of China), without regard to its conflict-of-law rules. Any dispute that cannot be settled amicably is subject to the exclusive jurisdiction of the courts of Taipei, Taiwan. If you are a consumer, the mandatory consumer protection laws of your country of residence are not affected.
