Terms of Service

1. Acceptance and eligibility

Anyone can use PupCal's countdowns, widgets and reminders without an account. To sign in, and so to use the cloud backup, the journal and the sharing features, you must be at least 13 years old, and if you are under 18 you need the permission of a parent or guardian, who accepts these terms for you. You must otherwise be able to enter into a binding agreement under the laws of your country. The terms of the App Store or Google Play from which you downloaded PupCal also apply to your use of the app.

2. Your licence to use PupCal

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use PupCal on devices you own or control, for your own non-commercial use. This licence does not give you any ownership of PupCal or its content.

3. In-app purchases

PupCal is free to download, and every calendar feature and widget is free. The Yorkie companion is included. The five other puppy companions are optional one-time purchases, individually or as a pack, that unlock that companion's illustrations for as long as the app is available on your store account.

Purchases are made through Apple or Google under their terms. Prices are shown in your local currency in the store before you confirm, and may differ between countries and over time. Payment, receipts and refunds are handled by the store according to its policies; we cannot issue refunds directly.

Purchases are tied to the store account used to buy them. You can restore them in Settings on any device signed in to the same Apple or Google account. Purchases cannot be transferred between the App Store and Google Play, and they do not include your own countdown data.

4. Your content

The days you create in PupCal, including their names and dates, and your journal entries belong to you. If you use PupCal without signing in, your days are stored only on your device and are not sent to us, so they cannot be recovered if the device is reset, replaced or lost.

While you are signed in, your days and settings are backed up to your account and your journal entries are synced, so that they come back when you sign in on another phone. You allow us to store and process them only to provide these features, as described in the Privacy Policy. PupCal is not meant to be the only copy of anything you cannot afford to lose.

5. Shared countdowns and spaces

Shared countdowns, companion spaces and direct shares are optional features that let you share with people you invite. To use them you sign in with a Google account, an Apple account where offered, or a link sent to your email address, and you must meet the age requirements above. You are responsible for what happens under your sign-in.

What you share remains yours: notes and photos you post, your display name and profile photo, your mood and status, and the countdowns you share. By sharing it, you give us a non-exclusive, royalty-free permission to store it and show it to the people you share it with for as long as it is shared, which is what these features need in order to work, and to retain snapshots of reported posts, profiles, statuses and shared countdown or space details, including available photo evidence, as described in the Privacy Policy. You must have the right to share anything you post, including photos of other people.

The owner of a group can remove posts and members and can disable invitation links. We may remove content, and suspend or terminate an account, that breaks these terms or the law, and we may delete groups that have been inactive for a long time after telling their members. When you leave a group you choose whether your posts stay or are deleted; deleting a group deletes its content.

You can report shared posts, profiles, statuses and shared countdown or space details from the app, choosing a reason and adding an optional note. Reported posts are hidden for you straight away. We review reports within 24 hours and may remove or reset content and suspend or terminate accounts that break these terms. You can also contact support@pupcal.app. We use automated checks before publishing shared text and accepting shared or profile photos; these checks can make mistakes, and you can contact us about a rejection. You can block another member to hide their posts, stop visits between your puppies and prevent their direct shares. View and undo blocks from your account in the app.

The sharing features depend on our server and third-party services. They may be unavailable at times, and we may change or discontinue them; if we do, we will give reasonable notice and a way to export or delete your content where practical.

6. Acceptable use

PupCal has zero tolerance for objectionable content and abusive users in any of its sharing features. Content that breaks these terms is removed, and the account that shared it may be suspended or terminated.

You agree not to:

• copy, modify, distribute, sell or rent any part of PupCal or its illustrations;
• reverse engineer, decompile or attempt to extract the source code or assets of PupCal, except where the law expressly allows it;
• circumvent or attempt to circumvent purchase verification;
• post or share, in a shared countdown, a space or a direct share, or as your display name, profile photo or status, spam or anything unlawful, abusive, hateful, violent or sexual, anything that invades another person's privacy, or anything you do not have the right to share;
• harass, threaten, bully or impersonate other members or people you share with;
• use invitation links or direct shares to join groups you were not invited to, to send unwanted invitations, or to disrupt a group or space;
• use PupCal in any way that breaks the law or infringes the rights of others.

7. Intellectual property

PupCal, its name, design, text and all puppy and scenario illustrations are owned by Maneko AI LLC or its licensors and are protected by copyright and other laws. Apart from the licence above, no rights are granted to you. In particular, the illustrations may not be extracted, reproduced or used outside PupCal.

8. Updates, changes and availability

We may update PupCal, add or remove features, or stop offering it. Widgets, reminders, notifications and purchases depend on your device, operating system and store, and we cannot promise that they will always be available or work in the same way on every device. Reminders are scheduled locally by your phone and may be delayed or suppressed by its settings, and notifications about shares depend on Apple's and Google's push services.

9. Termination

You can stop using PupCal at any time. If you never signed in, deleting the app removes everything. To end your account, delete it in the app (open Account and tap Delete account) or follow the steps at https://pupcal.app/delete. The account is deleted 30 days after you ask, and you can keep it by signing in before then; after that its data is removed as described in the Privacy Policy.

We may suspend or terminate your account, or your access to the sharing features, if you break these terms or the law, or where we need to in order to protect other people or PupCal. A suspension does not delete your data, and you can still ask us at support@pupcal.app to delete your account.

When your account is deleted, your backup, journal, profile photo and the posts you shared are deleted with it, subject to the records retained for moderation and to finish interrupted profile-photo deletion, as described in the Privacy Policy. Interrupted photo deletion may finish later. Purchases are made with Apple or Google and stay with your store account: ending your account does not refund or remove them, and companions you bought come back with Restore purchases on the same store account.

The sections on intellectual property, disclaimer of warranties, limitation of liability and governing law continue to apply after your use of PupCal ends.

10. Disclaimer of warranties

PupCal is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. Countdowns depend on the date, time and time zone of your device. PupCal is a companion, not a substitute for an official calendar or reminder system for anything critical.

11. Limitation of liability

To the fullest extent permitted by law, Maneko AI LLC is not liable for any indirect, incidental, special or consequential damages, or for loss of data or profits, arising from your use of or inability to use PupCal. Our total liability for any claim relating to PupCal is limited to the amount you paid us for PupCal in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited under the law of your country of residence.

12. Changes to these terms

We may revise these terms from time to time. The date at the top shows when they were last changed. If a change is material, we will point it out in the app or on the website. Continuing to use PupCal after a change means you accept the revised terms.

13. Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Any dispute that cannot be settled amicably is subject to the exclusive jurisdiction of the state and federal courts located in California. If you are a consumer, this does not take away the protection of the mandatory laws of your country of residence, and if you live in the European Union, the United Kingdom or Japan you may also bring a claim in the courts where you live.
